Terms of Service

By accessing or using TheHyWing mobile application and services ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

TheHyWing is a climate-risk intelligence and preventive health platform. The Service provides multi-hazard climate risk alerts, AI-powered symptom assessment (informational only), hydration tracking, telehealth consultations with licensed clinicians, health vitals tracking, multi-hazard risk assessments, caregiver mode, and agricultural livelihood protection (Farm Intel) including crop climate risk, livestock welfare scoring, pest/disease warnings, and crop calendar guidance.

3. User Accounts

You must be at least 18 years old (or the age of majority in your jurisdiction). You must provide accurate information and maintain account security. Account roles: USER (standard monitoring), CLINICIAN (healthcare providers), ADMIN (system administrators).

4. Subscription Plans and Billing

Overage fees apply when plan limits are exceeded. All fees displayed in local currency at time of payment. Payments processed via Paystack (PCI DSS compliant). Consultation fees are generally non-refundable except in cases of technical failure.

5. Medical Consultations

All clinicians are licensed healthcare professionals whose credentials are verified by TheHyWing. Consultations are NOT for medical emergencies — call your local emergency services immediately in an emergency. Clinicians are licensed in specific jurisdictions; verify authorization for your region. Prescriptions and formal diagnoses may require in-person verification per local regulations.

6. AI-Powered Features — Transparency & Limitations

AI Disclosure (EU AI Act / Global Transparency):

TheHyWing uses AI (OpenAI GPT models) for symptom assessment, health recommendations, work schedule safety guidance, and personalized agricultural recommendations (Farm Intel)
AI outputs are informational software output only — they do NOT constitute medical diagnosis, prescription, treatment, or guaranteed agricultural outcomes
AI assessments are NOT reviewed by a clinician in real-time
The AI may produce inaccurate, incomplete, or inappropriate results
Always consult a qualified healthcare provider for medical decisions
You may opt out of AI features by using only manual consultation booking

7. Health Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our collection and use of information as described there.

8. Caregiver Mode

Users must explicitly grant consent for caregiver access. Consent can be revoked at any time. Caregivers may only access data for authorized users and must use information solely for health and safety purposes in compliance with applicable privacy laws.

9. Acceptable Use

You agree NOT to: use the Service for any illegal purpose, impersonate any person or entity, interfere with Service operations or security, attempt unauthorized access, share false health information, use automated systems without authorization, or reverse engineer the application.

10. Intellectual Property

TheHyWing and all related trademarks, logos, and content are owned by us or our licensors. You may not use our intellectual property without written permission.

11. Disclaimers and Limitation of Liability

No Medical Advice: THE SERVICE PROVIDES INFORMATION AND TOOLS BUT DOES NOT PROVIDE MEDICAL ADVICE. THE AI SYMPTOM CHECKER IS INFORMATIONAL SOFTWARE, NOT A MEDICAL DEVICE. ALWAYS CONSULT QUALIFIED HEALTHCARE PROFESSIONALS.

Weather Data: Weather and agricultural risk alerts are based on third-party data and research-backed thresholds. We do not guarantee accuracy, timeliness, or crop/livestock outcomes.

Farm Intel: Agricultural guidance (crop risks, livestock welfare, pest/disease warnings, planting calendars) is advisory. Actual conditions vary. We are not liable for crop losses, livestock mortality, or income impact from reliance on Farm Intel data.

Emergency Numbers: Emergency numbers shown are based on detected country/region. Always verify your local emergency number independently.

Service Availability: THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

Limitation: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.

12. Emergency Situations

FOR MEDICAL EMERGENCIES, DO NOT RELY ON THIS APP. CALL YOUR LOCAL EMERGENCY SERVICES IMMEDIATELY.

TheHyWing displays country-appropriate emergency numbers as a convenience, but you should verify your local emergency number independently.

13. Indemnification

You agree to indemnify and hold harmless TheHyWing from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

14. Termination

We may suspend or terminate your access at any time for violation of these Terms. You may delete your account at any time through app settings or by contacting support.

15. Governing Law

These Terms are governed by the laws of the jurisdiction in which TheHyWing is incorporated. For users in the European Economic Area, nothing in these Terms affects your statutory rights under applicable EU consumer protection and data protection laws. Local mandatory consumer protection laws apply where they cannot be contractually overridden.

16. Dispute Resolution

Disputes arising from these Terms shall first be attempted to be resolved through good faith negotiation. If unresolved within 30 days, disputes may be submitted to mediation or binding arbitration. Users in the EU retain the right to bring claims before their local courts.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

18. Changes to Terms

We reserve the right to modify these Terms at any time. Significant changes will be notified via email or in-app notification. Continued use after changes constitutes acceptance.
