Terms of Service

1. Acceptance of Terms

By accessing or using TheHyWing mobile application and services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

TheHyWing provides:

• Heat stress monitoring and alerts based on weather conditions
• Hydration tracking and reminders
• Telehealth consultations with licensed clinicians
• Health vitals tracking
• Multi-hazard risk assessments (heat, cold, rain, air quality)
• Caregiver mode for monitoring multiple users with consent

3. User Accounts

3.1 Registration

• You must be at least 18 years old to use the Service
• You must provide accurate and complete information
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized access

3.2 Account Roles

• USER: Standard health monitoring features
• CLINICIAN: Healthcare providers conducting consultations
• ADMIN: System administrators (restricted access)

4. Subscription Plans and Billing

4.1 Plans

• BASIC: Free tier with alerts and monitoring (consultations require upgrade)
• STANDARD: 2 included consultations per month
• PREMIUM: 3 included consultations per month

4.2 Payment Terms

• Consultation overages are charged at ₦2,500 per consultation
• Overage consultations require explicit payment confirmation
• Monthly limits reset on the first day of each calendar month
• All fees are in Nigerian Naira (₦) unless otherwise stated
• Payments are securely processed via Paystack, a third-party payment processor

4.3 Refunds

Consultation fees are generally non-refundable except in cases of technical failure or service unavailability. Contact support@thehywing.com for refund requests.

5. Medical Consultations

5.1 Clinician Qualifications

All clinicians on the platform are licensed healthcare professionals. However, TheHyWing does not guarantee availability or outcomes of consultations.

5.2 Consultation Limitations

• Consultations are NOT for medical emergencies. Call emergency services (112) for emergencies
• Consultations may have scheduling delays based on clinician availability
• Clinicians may decline consultations outside their area of expertise
• Prescriptions and formal diagnoses require in-person verification as per local regulations

5.3 Cancellations

You may cancel scheduled consultations. Fees may apply based on cancellation timing.

6. Health Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our collection and use of health information as described in the Privacy Policy.

7. Caregiver Mode

7.1 Consent Requirements

• Users must explicitly grant consent for caregiver access
• Consent can be revoked at any time
• Caregivers may only access data for users who have granted consent

7.2 Caregiver Responsibilities

Caregivers must use accessed information solely for the health and safety of assigned users and in compliance with all applicable privacy laws.

8. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose
• Impersonate any person or entity
• Interfere with the Service's operation or security
• Attempt to gain unauthorized access to systems or user accounts
• Share false or misleading health information intentionally
• Use automated systems (bots) to access the Service
• Reverse engineer or decompile the application

9. Intellectual Property

TheHyWing and all related trademarks, logos, and content are owned by us or our licensors. You may not use our intellectual property without written permission.

10. Disclaimers and Limitation of Liability

11. Indemnification

You agree to indemnify and hold harmless TheHyWing from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason. You may terminate your account at any time through the app settings.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or in-app notification. Continued use after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Disputes shall be resolved in Nigerian courts.

15. Emergency Situations

🚨 FOR MEDICAL EMERGENCIES, DO NOT USE THIS APP. CALL EMERGENCY SERVICES (112 in Nigeria) IMMEDIATELY.

16. Dispute Resolution

Any disputes arising from these Terms or use of the Service shall first be attempted to be resolved through good faith negotiation. If unresolved, disputes may be submitted to mediation or arbitration as agreed by both parties.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect.
